July 20, 2017: Indictment of Rebecca Drew

STATE OF MARYLAND, ALLEGANY COUNTY, TO WIT:

The Jurors of the State of Maryland, for the body of Allegany County, do on their oath present that REBECCA D. DREW, late of Allegany County, from on or about July 5, 2016 and through and including on or about December 20, 2016, in the County aforesaid, in violation and perversion of her duties as the duly elected Register of Wills for Allegany County, did corruptly commit misconduct in office by knowingly, willfully, and intentionally, under the color of her office, stealing money, the property of the State of Maryland, to wit: being then and there the duly elected Register of Wills and having signature authority over the bank account and possession of a credit card of that public office, did willfully and knowingly exert unauthorized control over the funds of the State of Maryland, spending approximately $4309.00 in cash from those accounts for her personal use and benefit, in violation of the common law and against the peace, government and dignity of the State.

 SECOND COUNT

And, the jurors aforesaid, upon their oath aforesaid, do further present that REBECCA D. DREW, late of Allegany County, from on or about  September 15, 2016 and through and including on or about December 20, 2016, in the County aforesaid, did, pursuant to a common scheme and continuing course of conduct, steal money having a value exceeding ONE THOUSAND DOLLARS ($1,000.00), but less than TEN THOUSAND DOLLARS ($10,000.00), property of the State of Maryland to wit: being then and there the duly elected Register of Wills for Allegany County, and having signature authority over the bank account of that public office , did willfully and knowingly exert unauthorized control over the funds of the State of Maryland, writing several checks totaling approximately $2643.00 addressed to and signed by herself  from that account for her personal use and benefit, in violation of Section § 7-104 of the Criminal Law Article, Annotated Code of Maryland and against the peace, government and dignity of the State

THIRD COUNT

And the jurors aforesaid, upon their oath aforesaid, do further present that Rebecca D. Drew, late of Allegany County, from on or about July 5, 2016 and through and including on or about November 1, 2016, at the County aforesaid, did, pursuant to a common scheme and continuing course of conduct, steal money having a value exceeding ONE THOUSAND DOLLARS ($1,000.00), but less than TEN THOUSAND DOLLARS ($10,000.00), property of the State of Maryland, to wit: being then and there the duly elected Register of Wills for Allegany County and having possession of a credit card of that entity, did willfully and knowingly exert unauthorized control over the funds of State of Maryland by making numerous credit card purchases totaling approximately $1666.00 for her personal use and benefit, in violation of Section § 7-104 of the Criminal Law Article, Annotated Code of Maryland and against the peace, government and dignity of the State

Penalty: 10 years and/or $10,000.

FOURTH COUNT

And the jurors aforesaid, upon their oath aforesaid, do further present that REBECCA D. DREW, being then and there the duly elected Register of Wills for Allegany County, charged with the fiduciary duty to ensure that the funds of that public office are used for their designated purpose, in violation of said fiduciary duty, did fraudulently and willfully misappropriate monies of the State of Maryland to wit: approximately $4309.00 held by her in a fiduciary capacity for the State of Maryland, for her personal use and benefit contrary to the trust reposed in her, in violation of Section 7-113 of the Criminal Law Article and against the peace, government and dignity of the State.
